                                                    WARRANTY

  

- Machinery and Equipment fabricated by MTJ is warranted to be free of defects in materials and /or workmanship for a period of one calendar year or 2000 operating hours which ever is the earlier.

  

- Materials and Components. Components supplied and used by MTJ to affect any installations, fabrications, repairs or modifications are warranted to the extent of the supplier’s warranty.

  

- Workmanship. Any defective workmanship reported within a period of three months, or 500 operating hours, which ever is the earlier, will be corrected by MTJ. Labour will be free of charge.  

 

- Commencement. Warranty shall commence on completion of the contracted work or production start up, which ever is the earlier. Failure of the client to acknowledge completion, in writing, shall not be cause for delay in the commencement of the warranty period.

 

- Exclusions. Warranty does not cover the reasonable cost of food, lodging and travel required in the performance of such warranty work; nor any work and material required as a result of; lack of appropriate maintenance; improper use of equipment; relocation, modification or adjustment not authorized by MTJ; damage from external source; change in ownership or such other reasonable exclusions as may arise from time to time.

 

- Availability for warranty work. The client shall either make available for repair, such defective item, equipment or assembly, within a reasonable period of time and by mutual agreement, or default the right to warranty work. Clear access to the equipment or assembly must be available at  the worksite.

 

- Definitions.

 

"make available" the client must provide an appropriate amount of time for the repair, on the day shift Monday to Friday, 7 AM to 5 PM.

 

"reasonable period" is a period not in excess of three calendar months from the time MTJ is made aware of the requirement for warranty work.

 

 "reasonable cost" is deemed to be:

- food. Three meals a day with non alcoholic beverages at a family, motel type restaurant, including fast food.

- lodging. Local Motel or Inn or other suitable lodging.

- travel. Economy class air, train or coach. Automobile reimbursed at MTJ's published rate.
